THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7412 OF 2017 ORDER:

An order of provisional assessment dated 26.08.2016, issued by the Assistant Divisional Engineer (Operation), Banswada, TSNPDCL, is under challenge in the present writ petition.

Heard the learned counsel for the petitioner, learned Government Pleader for Energy for the 1st respondent and Sri R.Vinod Reddy, learned standing counsel for the respondents 2 and 3.

According to the petitioner, the Gram Panchayat, Lakshmapur, used the domestic connection of the petitioner herein and consumed the electricity, because of acute shortage of water in the area. It is further stated by the learned counsel for the petitioner that Gram Panchayat did not pay any amount towards lease of the bore-well. Petitioner herein got issued a legal notice on receiving the impugned provisional assessment on 28.09.2016, pointing out a number of aspects. According to the learned counsel for the petitioner, the service connection has not been disconnected so far. It is further submitted by the learned counsel for the petitioner that the petitioner herein will make a

AVSS,J W.P.No.7412 of 2017 representation to the respondents to explain the ground realities.

On the other hand, it is submitted by the learned standing counsel that if any such representation is made, the respondents will consider the same, in accordance with law and appropriate orders will be passed thereon. 5.

Recording the said submission, this writ petition is disposed of, keeping it open for the petitioner herein to make a representation to the respondents, against the impugned provisional assessment, within a period of two weeks from the date of receipt of a copy of this order. If any such representation is made, the respondents herein shall consider the same and appropriate orders be passed, in accordance with law.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
