THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11233 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.4 in Crime No.390 of 2022 on the file of Abdullapurmet Police Station, Rachakonda, registered for the offences under Section 8 (c) r/w. 20 (b) (ii) (c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Learned counsel for the petitioner submits that petitioner's graduation examinations are scheduled and seeks relief of regular bail to the petitioner for the purpose of writing examinations.

Learned Additional Public Prosecutor on instructions would submit that the examinations of petitioner are scheduled and the hall ticket and other information provided are correct.

Keeping in view that petitioner is writing examinations, grant of tentative bail can be considered and he shall be release on bail, subject to following conditions:- i) The petitioner/Accused No.4 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Ranga Reddy District.

ii) The petitioner/Accused No.4 shall surrender on 26.12.2023 before the concerned Court. Needless to say that the Police are at liberty to take appropriate action if the petitioner fails to surrender on the said date and no extension will be granted.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
