THE HON'BLE SRI JUSTICE P.KESHAVA RAO CRIMINAL REVISION CASE No.776 OF 2005 ORDER:
Pursuant to the orders dated 24.11.2017 of this Court, the counsel for the petitioner has taken out notice to the first respondent through Registered Post with Acknowledgement Due. The registered cover has been returned on 13.12.2017 with postal endorsement 'addressee left, returned to sender'. The learned counsel appearing for the petitioner submits that he is unable to contact the petitioner and thereby he is not in a position to ascertain what is the correct address of the petitioner. He also submits that he informed his trial court counterpart through whom he got the brief, but he also expressed his inability to get the address of the petitioner.
Taking the said submission into consideration, this Court deems it appropriate to dismiss the Criminal Revision Case for non-prosecution. However, the counsel for the petitioner is given liberty to move an appropriate application as and when the petitioner contacts him to pursue the matter. Pending miscellaneous petitions, if any, shall also stand closed.
