ORDER
The Criminal Petition is filed under Section 482 Cr.P.C against the docket order, dated 28.03.2016, in Crl.M.P.No.390 of 2015 on the file of Judicial Magistrate of First Class, Kodad, whereunder and whereby the Court below prima facie, in view of the allegations made against the accused, had taken cognizance for the offences punishable under Sections 323 and 506 IPC, numbered the case as C.C.No.245 of 2016 and thereafter, issued summons to the accused. Challenging the same, the present Criminal Petition is filed.

Heard learned counsel for the petitioner/Accused and learned Additional Public Prosecutor representing the State. 3.
There are serious allegations against the petitioner/Accused. Therefore, it is not a fit case where the proceedings against him can be quashed. Truth or otherwise of the allegations can only be decided during the course of trial. Therefore, the docket order, dated 28.03.2016, in C.C.No.245 of 2016, passed by the Judicial Magistrate of First Class, Kodad needs no interference by this Court, However, considering the facts and circumstances of the case, the Court below is directed to proceed with the trial in C.C.No.245 of 2016 pending on the file of Judicial Magistrate of First Class, Kodad, and dispose of the same within a period of six
(6) months from the date of receipt of a copy of this order.

With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
