THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12481 of 2025 ORDER:

Seeking the Court to enlarge the petitioner, who arrayed as accused No.1 in Crime No.384 of 2025 of Malkajgiri Police Station, Rachakonda Commissionerate, on bail, the present petition is filed.

The brief facts of the case are that, on 23.05.2025, the de-facto complainant lodged a report with the Police stating that her younger daughter had committed suicide due to harassment caused by the petitioner. It was further stated that a suicide note was found in the right hand of the deceased, wherein she had named the petitioner as being responsible for her death. In view of these allegations, the complainant requested the police to initiate appropriate legal action against the petitioner. Based on the said complaint, the police registered a case vide Crime No.384 of 2025 for offences punishable under Section 108 of the Bharatiya Nyaya Sanhita (BNS).

Heard Sri Hanumanth Rao Parnandi, learned counsel appearing for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and has been in judicial custody since 03.07.2025 and that the material part of the investigation has already been completed and further detention of the petitioner is unnecessary and that a mandatory bail petition was filed, but the trial Court dismissed the same without proper consideration. He further submitted that there are apparent improvisations in the suicide note and discrepancies in the remand case diary and that the petitioner has been in custody for over 80 days, and even as of today, no charge sheet has been filed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are grave and serious in nature and that the

deceased had earlier lodged a complaint vide Crime No.768 of 2023, alleging offences punishable under Sections 366 and 376(2)(n) of IPC, and Section 5 read with Section 6 of the POCSO Act, which clearly indicate that the petitioner had exploited the victim. He further submitted that the deceased committed suicide due to continuous harassment by the petitioner. In view of the seriousness of the allegations and the nature of the offence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the petitioner has been in judicial custody since 03.07.2025 and a substantial part of the investigation has already been completed, and even as of today, no charge sheet has been filed. As per the prosecution and the remand case diary, the material portion of the investigation stands concluded. Considering the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Principal Junior Civil Judge-cumMetropolitan Magistrate, Medchal Malkajgiri District at Malkajgiri.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
