HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40441 of 2012 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in not demarcating the petitioner's land to an extent of Ac.29.00, situated at Survey No.2, 3, 37, 38, 39, 40, 41, Navaranguda Village, Uppal Mandal, Rangareddy District, as illegal and arbitrary and for a consequential direction to the respondent to demarcate the petitioner's land. The case of the petitioner is that she is the absolute owner and possessor of an extent of Ac.29.00 of agricultural land situated at Survey Nos. 2, 3, 37, 38, 39, 40, 41, Navaranguda Village, Uppal Mandal, Rangareddy District, and that the said property was devolved upon her husband by inheritance. While so, when the relatives of her husband tried to encroach the aforesaid land, the petitioner made a representation dated 21.09.2012 to the 2nd respondent to take necessary action for demarcation of the said land. But, till today, no action has been taken. As such, the petitioner filed the present writ petition.

It is to be seen that the grievance in the writ petition is purely civil dispute and the aspect of title, possession between private persons cannot be decided in the writ petition. More so, allegations were made against third parties and they are not impleaded in the writ petition. In view of the same, I do not see any merits in the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
