THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12512 of 2025 ORDER:

Seeking the Court to enlarge the petitioner, who arrayed as accused No.3 in Crime No.650 of 2025 of S.R. Nagar Police Station, Hyderabad, on bail, the present petition is filed. 2 .

The brief facts of the case are that, on 23.08.2025, on credible information regarding prostitution allegedly being run by certain persons, the complainant conducted a raid at Flat No.105. Upon knocking the door, the petitioner opened it and informed that he had been working at the said premises since June 2025 as a co-organizer on a salary basis of ₹25,000/- per month. The petitioner was subsequently arrested on the same day. Based on the said incident, a case was registered vide Crime No.650 of 2025 for offences punishable under Sections 143 and 144(2) of the Bharatiya Nyaya Sanhita (BNS), and Sections 3, 4, and 5 of the Immoral Traffic (Prevention) Act, 1956 (PIT Act).

Heard Ms. B. Keerthi Reddy, learned counsel appearing for M/s. Harsheet Reddy Law Firm on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and has been in judicial custody since 23.08.2025 and that the material part of the investigation has already been completed and further detention of the petitioner is unnecessary. She further submitted that even as per the remand case diary, the petitioner is working at the said premises on a salary basis of Rs.25,000/- per month and is not the organizer of the brothel house. Therefore, she prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the petitioner is also an organizer of the said brothel house and that the petitioner himself stated in the remand case diary that he is a co-organizer of the said brothel house. He further contended that as the investigation is still in progress, releasing the petitioner on

bail at this stage may lead to tampering with evidence or intimidation of witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the petitioner has been in judicial custody since 23.08.2025 and a substantial part of the investigation has already been completed and as there are no criminal antecedents against the petitioner, and according to the remand case dairy, he is working on a monthly salary of Rs.25,000/-, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of the learned III Additional Chief Metropolitan Magistrate at Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet

whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
