THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.39019 of 2015 ORDER:

Heard Sri Nandigam Krishna Rao, learned counsel for petitioners and Sri M.Sudheer, learned Standing Counsel for respondent Nos.2 and 3.

2. It is represented by counsel on both sides that the issue raised in this Writ Petition is covered by the order dt.13-11-2015 in W.P.No.24590 of 2015.

3. Therefore for reasons alike, this Writ Petition is also allowed and the action of 3rd respondent in not releasing the mortgage deeds/bonds of petitioners' properties even after the loans of petitioner had been waived by the 1st respondent, is declared as arbitrary and illegal and 3rd respondent is directed to release forthwith the mortgage deeds/bonds to petitioners by issuing clearance certificates to 4th respondent. No costs.

4. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
