THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Civil Revision Petition No.3156 of 2015 ORDER:

As against the decree passed in O.S. No.23 of 2010, dated 6.11.2014, passed by the Senior Civil Judge, Parchoor; a regular Appeal Suit in A.S. No.193 of 2014 was filed by the defendant on the file of VII-Additional District Judge, Ongole. At the time of granting stay, the lower Appellate Court directed the petitioner-appellant to deposit 50% of the decretal amount. As against the said order, the present Civil Revision Petition is filed.

This Court, on 28.12.2016, while granting interim stay imposed condition of depositing Rs.1,25,000/- within a period of four (4) weeks. It is not in dispute that the said condition was complied, and even the learned counsel for the respondent, Smt. Nimmagadda Revathi, would submit that the amount was also withdrawn.

Both, Sri G. Vasantha Rayudu, learned counsel for the petitioner and Smt. Nimmagadda Revathi, learned counsel for the respondent would arrive at a consensus that a direction be given to the lower Appellate Court to dispose of the Appeal Suit itself by fixing timeline.

In such an event, since the Appeal relates to the year 2014, the learned VII-Additional District Judge, Ongole, is directed to dispose of the Appeal Suit No.193 of 2014 as expeditiously as

possible not later than six (6) months from the date of receipt of a copy of the order.

Accordingly, the Civil Revision Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Revision shall stand closed.
