THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY CONTEMPT CASE No. 2131 OF 2018 ORDER:

This Contempt Case is filed alleging violation of orders passed dated 21.12.2017 passed by this Court in W.P.No.42907 of 2017.

By the above said order, this Court directed respondent No.3 to consider the representation submitted by the petitioner dated 26.10.2017, in strict accordance with procedure established by law and communicate the decision taken to the petitioners within a week thereafter. Further direction is also issued to respondent Nos.2 and 3 to initiate immediate appropriate action for removal of unauthorized constructions being carried out by respondent Nos.5 and 6, in strict accordance with procedure established by law. 3.

Notices have been issued in this contempt case on 31.10.2018 and a counter affidavit has been filed by respondent No.2-Deputy Commissioner GHMC stating that the respondent officials inspected the premises No.18-4-469 and also obtained photographs. It clearly shows that there are old tin sheet sheds and other plots are vacant divided by a compound wall. Therefore, the allegation made by the petitioner is totally false

and baseless with regard to the house bearing No.18-4-469 is concerned. Since there are no new constructions being observed in the inspection, the respondents have not taken any steps of removal of alleged illegal constructions. Accordingly, the representation of the petitioner is considered and disposed of duly intimating the same by an intimation letter dated 19.10.2018.

Since the respondents have considered the representation of the petitioner and inspected the alleged premises, no further orders are necessary in this contempt case.

Accordingly, this Contempt Case is closed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
