THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11234 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.1126 of 2023 on the file of Madhapur Police Station, Ranga Reddy District, registered for the offences under Sections 370 and 370 (A) (2) of IPC and Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Police, Madhapur is that on receiving information that some persons were running prostitution, they went to the said flat and found one Ramesh, Sathibabu, Reshma and Muralidahar Rao. On enquiry, they have stated that on instructions of this petitioner and one Anusha, they were running prostitution. Basing on the said complaint, the present crime is registered against this petitioner/A-1 and others.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and she has been falsely implicated in the case basing on the confession of A-2 to A6. 5.
Since the basis for implication of this petitioner is confession of A-2 to A-6, the petitioner can be granted the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the X Additional Metropolitan Magistrate at Kukatpally.
ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of four weeks for the purpose of investigation and thereafter, as and when required.
(iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
