THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CIVIL REVISION PETITION No.4576 of 2018 ORDER:

This civil revision petition, under Article 227 of the Constitution of India, is filed by the petitioner-third party/claim petitioner, stating that the claim petition (un-numbered claim petition), filed in E.P.No.115 of 2017 in O.S.No.130 of 2013, is being returned by the Court of learned Additional Senior Civil Judge, Ongole, without registering it despite proper compliance of the objections taken by the office of the said Court. 2.

As this Court is inclined to dispose of the revision petition at the stage of admission, no notice is ordered to the respondents. 3.

I have heard the submissions of Sri Kolluri Arjun Chowdary, learned counsel appearing for the revision petitioner. I have perused the material record.

From a perusal of the record and on consideration of the submissions it is noticeable that the subject unnumbered claim petition was returned twice by the office of the Court below with office objections and that the claim petition was re-presented after complying with the objections and that, thereafter, the claim petition was returned finally, on 20.04.2018, directing the petitioner to file a neat copy of the said petition. Thereafter, this revision petition is filed.

Having regard to the facts and submissions, the Civil Revision Petition is disposed of directing the petitioner herein to re-present the claim petition within a week from the date of receipt of a copy of

this order. It is needless to state that on the petitioner re-presenting the claim petition along with a neat copy of it, the Court below shall direct its office to scrutinise the same and register the claim petition, if it is otherwise in order.

There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
