THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38520 of 2015 ORDER:
The grievance of the petitioner was that the Station House Officer, Central Crime Station, Hyderabad, and the Assistant Commissioner of Police, Central Crime Station, Hyderabad, respondents 2 and 3, were frequently calling him to the police station and harassing him without any crime being registered against him. This interference was stated to be on the pretext of investigation in Crime No.277 of 2015 on the file of the Central Crime Station though the petitioner was not shown as an accused therein.
The Assistant Commissioner of Police, Team-IV, Central Crime Station, Detective Department, Hyderabad, furnished written instructions dated 02.12.2015 to the office of the learned Government Pleader for Home, wherein he stated that on the complaint made by one Mohd. Abdul Khader, General Manager, (P&A), HMWS&SB, Crime No.277 of 2015 had been registered against some unknown persons who had committed a job fraud. He further stated that respondents 2 and 3 were not aware of the name of the petitioner and therefore the question of calling him to the police station and making him sit there for hours together did not arise. He further stated that the investigation revealed that the petitioner, who had worked as a contractor for HMWS&SB, had access to the organization and that it was possible that he could have exploited the same.
Efforts to enquire into the involvement of the petitioner, if any, were stated to have failed as he avoided questioning by the police. The Assistant Commissioner further stated that if a prima facie case was established against the petitioner during the course of the investigation, the Central Crime Station police authorities would proceed in the matter in accordance with law. The afore-stated stand of the police authorities is duly taken on record. In the light thereof, no adjudication is called for in this writ petition, which is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
