HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 24762 of 2016 Order:

The husband of the petitioner was appointed as a Driver in the fourth respondent-Corporation with effect from 18.11.1982. His services were regularized. He was given revision of pay scales of 1993, 1999 and 2005. He retired from service on 30.04.2012. After retirement he died on 29.01.2013. Since the amounts due to the deceased towards encashment of earned leave, gratuity and differential amount of revised pay scales were not paid, the petitioner submitted a representation to the fourth respondent on 03.02.2014. In response to the same, the fourth respondent issued proceedings on 04.04.2014 directing the Accounts Section to draw an amount of Rs.1,72,109/- towards payment of gratuity and disburse the said amount to the petitioner. In spite of the said orders no amount was paid to the petitioner. The petitioner submitted further representations on 06.04.2015 and 16.04.2016 to the respondents 3 and 4 and when there is no response, the present Writ Petition is filed.

2. This Court, by an order dated 26.07.2016, ordered notice before admission and permitted the learned counsel for the petitioner to take out personal notice to the respondents. The notices to the respondents were served on 03.08.2016. In spite of the same, there is no appearance on behalf of the respondents.

3. In the circumstances, this Writ Petition is disposed of directing the fourth respondent to consider the representations of the petitioner dated 06.04.2015 and 16.04.2016, verify the records and make necessary payments of the amounts due to the petitioner within a period of three (3) months from the date of receipt of a copy of this order.

4. The Writ Petition is, accordingly, disposed of. There shall be no

order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
