THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4621 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking to grant bail in connection with crime No.99 of 2015 on the file of the P.S., Hayath Nagar, Cyberabad, registered for the offences under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The allegation against the petitioner/A.1 is that he along with four others was traveling in swift car bearing No.AP 13 AF 8419 and was transporting ganja and that the said ganja was seized by the excise officials and was weighed at 10 kgs. The petitioner was arrested on 07.02.2015 and he has been in jail since then. In the facts and circumstances of the case and also in view of the quantity of ganja seized, the criminal petition is allowed and the petitioner shall be enlarged on bail on condition of the petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for the likesum each to the satisfaction of VII Metropolitan Magistrate, Hayathnagar, Cyberabad.
