G Santosh v. A Sujatha
THE HON'BLE SRI JUSTI CE SANJAY KUMAR CI VI L REVI SI ON PETI TI ON NO.4512 OF 2018
O R D E R
This civil revision petition arises out of the order dated 09.04.2018 passed by the appellate Court of the learned XIII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, in I.A.No.32 of 2018 in A.S.No.6 of 2018. The said I.A. was filed by the petitioners herein, being the appellants in A.S.No.6 of 2018, under Order 41 Rule 5 CPC seeking suspension of the judgment and decree dated 22.09.2017 in O.S.No.95 of 2015 on the file of the learned I Additional Junior Civil Judge, Ranga Reddy District at L.B.Nagar. By the order under revision, the appellate Court dismissed the I.A. Sri R.A.Achuthanand, learned counsel for the petitioners, would fairly state that even during the pendency of the suit, the plaintiffs therein, the respondents in this CRP, had the benefit of an injunction order. In that view of the matter, this Court sees no grounds to entertain this civil revision petition.
The civil revision petition is accordingly dismissed. However, as the valuable property rights of the parties are involved, the appellate Court of the learned XIII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, is directed to dispose of A.S.No.6 of 2018 expeditiously and preferably within four months from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
