Heard Mr.G.L.Narsimha Rao for petitioner and the learned Assistant Government Pleader for respondents 1 to 3.
Aggrieved by the action of the 3rd respondent in issuing directions to close the bore well of the petitioner vide proceedings No.B/726/2017, dated 29.01.2018, the present writ petition is filed.
Against the order of the 3rd respondent, petitioner filed appeal before the 2nd respondent.
One of the grounds raised by the petitioner is that there is no breach of provisions of WALTA Act, 2002 and the appeal filed by the petitioner is not considered and disposed of.
I have perused the record and prima facie this Court is of the view that inaction results in hardship to petitioner. Hence, the writ petition is disposed of by this order:
(a) The 2nd respondent considers the appeal filed by the petitioner within two (02) months from the date of receipt of copy of this order.
(b) Status quo as regards enjoyment of subject bore well as on date is maintained for a period of two
(02) months from today. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
