This company petition is filed for an order for winding up the respondent for nonpayment of the debt due to the petitioner. At the hearing, Mr. Deepak Misra, learned counsel, representing Mr. K. Anoop Kumar, learned counsel for the petitioner, and Mr. Y. Koteswara Rao, learned counsel for the respondent, submitted that the dispute between the parties has been settled amicably. Mr. Y. Koteswara Rao has placed before the Court four Nos. of
cheques for a total sum of Rs.17,89,640/- (Rupees seventeen lakhs eighty nine thousand six hundred and forty only) issued in favour of the petitioner in full and final settlement of the latter's claim. Mr. Deepak Misra, learned counsel appearing for the petitioner, has received these cheques and submitted that as the dispute is settled by the petitioner, the company petition may be closed with liberty to the petitioner to seek revival of the company petition, in the event any of the cheques is dishonoured.
