THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION NO.12495 OF 2025 ORAL ORDER:

This criminal petition is filed by the petitioner/accused seeking anticipatory bail in connection with FIR.No.207 of 2025 on the file of Thangalapalli Police Station, Rajanna Sircilla District, registered for the offences punishable under Sections 308(2) read with 62 of BNS.

Heard Sri K.Pradeep Kumar, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing on behalf of respondents - State. 3.

Learned counsel for the petitioner contended that petitioner is innocent of the offences as alleged and that there is inordinate delay in lodging report against the petitioner. He further contended that a counter case is also filed by petitioner. Therefore, he prayed the Court to grant the relief of anticipatory bail to the petitioner by allowing this criminal petition. 4.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the

petitioner stating that there are five other crimes pending against this petitioner. Therefore, he prayed the Court to dismiss the criminal petition.

Considering the facts and circumstances of the case, this Court deems it fit to direct the petitioner to surrender before the I Additional Sessions Judge, at Rajanna Sircilla, and upon such surrender, file a petition seeking regular bail. On filing of such petition before the trial Court, the trial Court is directed to consider the same as expeditiously as possible and pass appropriate orders in accordance with law.

With the above directions, this Criminal Petition is disposed of.

Miscellaneous petitions, pending, if any, shall stand closed.
