HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9086 of 2017 ORDER:

Heard learned counsel for the petitioners, learned Public Prosecutor and perused the record.

This Criminal Petition is filed by the petitioners-accused Nos.1 to 3 to quash charge sheet, dated 08.8.2016, in P.R.C.No.22 of 2016 on the file of the Judicial Magistrate of First Class, Metpally, Jagtiyal District.

Learned counsel for the petitioners would submit that there are no specific allegations against the petitioners-accused Nos.1 to 3 to constitute the offence under Section-306 read with 34 I.P.C.

Learned Public Prosecutor opposed the same stating that there are specific and grave allegations against the petitioners to constitute the offence under Section-306 read with 34 I.P.C. It is brought to the notice of the Court that the case has not been committed to the Court of Sessions. On committal, the petitioners-accused Nos.1 to 3 can file an application for their discharge. On filing of such application, the Court below may expeditiously dispose of the same in accordance with law.

With this direction, the Criminal Petition is disposed of. As a sequel, the Miscellaneous Petitions, if any, shall stand disposed of.
