THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 11297 OF 2023 ORDER:

This Criminal Petition is filed under Section 439(1) (b) of Cr.P.C. by the petitioners/Accused Nos.7 & 8 seeking to relax the condition imposed in the order dated 22.09.2023 in Crl.M.P.No.264 of 2023.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner approached the Session Court and the learned Sessions Judge granted the relief of anticipatory bail vide order dated 22.09.2023 in Crl.M.P.No.264 of 2023. In the said order, petitioners were directed to surrender before the Station House Officer, Burgampahad within 10 days from the date of the order. Pursuant to said surrender, they shall be released on bail on executing personal bond for Rs.20,000/- each with two sureties.

Learned counsel appearing for the petitioners would submit that petitioners could not provide surety amount for which reason, they have not surrendered.

In the said circumstances of the case, the petitioners are directed to surrender before the Station House Officer, Burgampahad on 20.11.2023. On such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.20,000/- each with two sureties, failing which, the Police are at liberty to take appropriate action. All other conditions imposed by the learned Sessions Judge shall remain unaltered. 6.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
