Kaji Nooruddin, v. The State Of Telangana,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.8217 OF 2016 O R D E R :
Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.
2. Petitioner's grievance is that he had applied to respondents 2 and 3 on 16.07.2015 for survey of his land in respect of plot Nos.38 and 39 in survey Nos.277, 278 and 276-part totally admeasuring 1595 sq.yards of Shastripuram Colony, Mylardevpalli Village of Rajandranagar Mandal, Ranga Reddy District and that the respondents 2 and 3 are not taking any action, even though he had paid charges for the said survey.
3. On 03.03.2016 in W.P.No.6690 of 2016 this Court has considered the issue of survey in respect of private land, subject to collection of requisite charges, by the officials of the Survey Department and held that such a survey can be directed as per law.
4. Therefore, for reasons alike, this Writ Petition is also disposed of directing the respondents 2 and 3 to conduct survey by demarcating and fixing boundaries to the petitioner's land, after issuing notice to all the affected parties and after collecting necessary charges for the same, within a period of twelve (12) weeks from the date of receipt of a copy of this order. It is made clear that any survey conducted by the respondents 2 and 3 will not affect the right, title and interest of any third parties. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
