HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27569 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondent Nos.4 to 8 in interfering with the civil disputes with regard to the property to an extent of 16 1⁄2 cents in R.S.No.790, Patamata Veedhi, Khaza Village, Movva Mandal, Krishna District and in threatening the petitioners to withdraw the suit in OS.No.53/2018 pending on the file of Prl.Junior Civil Judge, Avanigadda.

Heard learned counsel the petitioners.

Learned Assistant Government Pleader for Home produced written instructions stating that at the instance of 11th respondent a case was registered against the petitioners in Crime No.98/2018, for the offences under Section 341, 323, 506 r/w.3 IPC of Kuchipudi P.S.; that during the course of investigation notice under Section 41(A) Cr.P.C. was served on the petitioners; and as such they were called to police station for investigation purpose only. It is further stated that the respondent police never threatened the petitioners to withdraw the suit, as they have no knowledge about pendency of the civil suit between the petitioners and respondents Nos.9 to 12 and that they have never interfered in their civil disputes. It is also stated that during the course of investigation in the aforesaid crime, it was disclosed that another case is also

registered against the petitioners basing on the complaint of the 10th respondent which is subject matter of Crime No.87/2017. Recording the aforesaid submissions of the learned Assistant Government Pleader, the writ petition is disposed of. However, the respondent police shall not interfere with the civil disputes pending between the petitioners and unofficial respondents and shall not pressurise the petitioner to withdraw the suit in OS.No.53/2018. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
