THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO A N D THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.594 of 2013 ORDER: (Per Hon'ble Sri Justice Nooty Ramamohana Rao) Learned counsel for the respondents has drawn our attention to the rectification deed, which was executed incorporating the condition that the transfer/sale is subject to the result of the appeal in A.S.No.652/2005 pending in this Court.

In that view of the matter, though an error has been committed in not mentioning the said clause when the original sale deed is executed and since the same is rectified subsequently by incorporating the said condition, the parties cannot be proceeded against for contempt of court action. Hence, accepting the explanation offered by the respondents, we discharge the contempt case. Accordingly, the contempt case stands dismissed. No order as to costs.

The miscellaneous petitions, if any, pending in this case shall stand closed.
