HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 4837 of 2017 Order:

This Writ Petition is filed challenging the action of the third respondent in interfering with the civil dispute pertaining to the properties of the petitioners situated in several survey numbers of Relli village, Kothavalasa Mandal, Vizianagaram district.

Now, a counter affidavit is filed by the third respondent stating that there is a dispute with regard to land in Survey No.184/6 between the petitioners and the respondents 4 and 5. Since the matter is civil in nature, the respondents 4 and 5 were directed to approach the Civil Court. When the second petitioner also lodged a complaint on 13.02.2017 he was also advised to approach the Civil Court. As a part of enquiry, the third respondent called the petitioners as well as the respondents 4 and 5 and suggested them to approach the Civil Court. The other allegations of forcing the petitioners to part with the property and interfering in the civil dispute are denied.

In view of the averments made in the counter affidavit, no further orders are necessary in the present Writ Petition. The Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
