SMT. JUSTICE T. RAJANI CRIMINAL PETITION NO. 8215 OF 2018 O R D E R :

This Criminal Petition is filed by the petitioner/A-1 under section 438 of Cr.P.C., seeking for grant of anticipatory bail in Crime No. 93 of 2016 Gurrampode Police Station, Rachakonda District registered for the offences punishable under section 409, 420, 468, 471 read with 34 of I.P.C.

2. Heard Sri C. Sharan Reddy, learned counsel for the petitioner/A-1 and the learned Public Prosecutor for the respondent/State.

3. The counsel for the petitioner submits that the first complaint which was given by the father is only attracting the offences under section 323 and 506 of I.P.C., which are bailable. It is only subsequent to the death of the father of the petitioner that another report was given by his father on the face of which the section of law was altered to section 304 Part-II of IPC. But the record shows that the father of the petitioner died due to the injuries sustained in the beating by the petitioner.

4. Hence, considering the nature of the offence, this Court opines that it is not a fit case to grant anticipatory bail to the petitioner.

5. In the result, the Criminal Petition is dismissed. However, the petitioner is at liberty to surrender before the concerned court within two weeks from the date of receipt of a copy of this order. On such surrender before the concerned court, the lower court shall consider the bail application on the same day, subject to the pressure of work.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
