Nagar, Hyderabad. .....Respondent Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ of mandamus or any other appropriate writ, order or direction, declaring the action of the respondent in issuing the proceedings Lr.No.LRS/15296/C3/EZ/GHMC dt.29.10.2011 as illegal, arbitrary and in violation of the principles of natural justice and set aside the same and further direct the respondent to regularise the petitioner's property in light of the G.O.Ms.No.902 dt.31.12.2007.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri U. Shanthi Bhushan Rao, Advocate for the Petitioner, and Sri C. Damodar Reddy, learned Standing Counsel for the Respondent, the Court made the following ORDER:
Issue notice to the Commissioner, Greater Hyderabad Municipal Corporation, to explain as to why 1) he has not taken any steps to get the ex parte decree passed in O.S.No.1397 of 2005, first of all, set aside;
2) Greater Hyderabad Municipal Corporation has not proceeded against any of the erring employees, who stayed away deliberately from the Court proceedings; 3) as to what action has been initiated against the learned Standing Counsel for the Corporation, who failed to attend to the Court below; and 4) why this Court shall not draw an inference that for extraneous reasons, considerations and practices, which can be described as corrupt, this kind of voluntary suffering is inflicted upon the Corporation.
The Commissioner, Greater Hyderabad Municipal Corporation shall also address as to why from now on, at the cost of the lay out developers, all open spaces shall not be fenced and then, handed over to the Corporation.
