THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY Crl.P.MP.Nos.19033 and 19034 of 2016 In/and Crl.P.No.16887 of 2016 COMMON ORDER:
The main Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.') to quash the proceedings in S.C.No.59 of 2016 on the file of Special Judge for trial of offences under SCs and STs (POA) Act-cum-Additional District Judge, Khammam, registered for the offences punishable under Sections 294(b), 417, 420, 506 IPC and Section 3 (i) (xii) of SCs and STs (POA) Act, 1989.
2.
Crl.P.MP.Nos.19033 and 19034 of 2016 are filed to permit the petitioner to compound the aforesaid offences and to record the compromise entered by the parties and to quash the proceedings in the aforesaid S.C.
3. Both the parties are present-in-person and they are identified by their respective counsel and the parties also produced photostat copies of their Aadhar Cards in proof of identity.
4.
Since the offences stated above are not compoundable offences, this Court can exercise its power under Section 482 Cr.P.C. to quash the proceedings as both the parties are appeared and stated that they settled the matter and the offences punishable under Section 294(b), 417 and under Section 3 (i) (xii) of SCs and STs (POA) Act, 1989, allegedly committed by the petitioner are almost identical allegations, but the dispute is settled at the intervention of elders.
5. Since the petitioner and respondent No.2 have compromised the matter at the intervention of elders and in view of the principle laid down in Gian Singh v. State of Punjab and another1, and in view of the interest of the parties, I find that 1 (2012) 10 SCC 303
Crl.P.No.16887of 2016 MSM,J it is a fit case to permit the petitioner and respondent No.2 to compound the offences.
6. Accordingly, Crl.P.MP.Nos.19033 and 19034 of 2016 are allowed. In view of the orders passed in the aforesaid petitions, the proceedings in S.C.No.59 of 2016 on the file of Special Judge for trial of offences under SCs and STs (POA) Act-cum-Additional District Judge, Khammam, are quashed. Accordingly, Crl.P.No.16887 of 2016 is allowed.
Miscellaneous Petitions, if any, pending in this Petition, shall stand closed. __________________________________ M. SATYANARAYANA MURTHY, J December 19, 2016.
