O R D E R

The petitioner is the husband of the 2nd respondent and father of respondents 3 and 4. Owing to the alleged disputes, the petitioner and the respondent 2 are living separately and the respondents 3 and 4 are with respondent No.2. The 2nd respondent filed M.C.No.44 of 2015 on the file of Family Court, Warangal, seeking maintenance under Section 125 of Cr.P.C. and pending the main case, filed Crl.M.P.No.228/2015 in M.C.No.44/2015 seeking interim maintenance. The trial court by the impugned order dated 9.3.2016 directed the petitioner herein to pay an amount of Rs.1,500/- each to respondents 3 and 4 herein and in respect of respondent No.1, the trial court dismissed her claim for maintenance as not pressed. Hence the present criminal petition under Section 482 Cr.P.C. to quash the maintenance proceedings.

From the material on record, it could be seen that undisputedly, the respondents 3 and 4 are the minor children of the petitioner and considering the present cost of living, their age and considering the facts and circumstances, the trial court directed the petitioner to pay an amount of Rs.1,500/- each to respondents 3 and 4 herein, who are his children. The said amount at any stretch of imagination can be said to be exorbitant and the criminal petition is devoid of any merits and the same is dismissed at the stage of admission. No costs.
