HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL APPEAL No.449 of 2007 JUDGMENT:

This appeal is filed by the complainant against the Judgment dated 9.2.2007 passed by the Special Judicial Magistrate of First class, Excise, Karimnagar in C.C.No.400 of 2004.

On the complaint lodged by the complainant, the 1st respondent was tried in the above C.C. for the offence under Section 138 of the Negotiable Instruments Act. On appreciation of the evidence record, the learned Magistrate acquitted the 1st respondent. Aggrieved by the same, the complainant filed this appeal.

When this matter has been taken up, the learned Counsel for the appellant as well as the 1st respondent submitted that the complainant and the 1st respondent are sister and brother and that the matter was settled out of Court and therefore, no orders need be passed in this appeal.
