THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9233 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioners/accused Nos.2 to 5, who are arrayed as accused Nos. 1 and 2 to 5 in Crime No.266 of 2022 of Geesugonda Police Station, Warangal District, registered for the offences punishable under Sections 498-A, 306 read with 511 read with Section 34 of Indian Penal Code (for short "IPC").

Heard learned counsel for the petitioners/accused Nos.2 to 5 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The complaint was lodged by the maternal uncle of the victim stating that the victim fell in love with accused No.1 and married him. Some months after the marriage, accused No.1 and these petitioners, who are her in-laws, started harassing her physically and mentally for want of additional dowry. Unable to bear the said harassment, the victim on 27.09.2022 consumed pesticide poison in the village by taking a selfie video stating that her husband/accused

No.1 and these petitioners were responsible for committing of suicide.

Learned counsel for the petitioners submits that in fact there is no proof that the victim is married to accused No.1 and it is their case that to force accused No.1 to marry the victim, she had in fact threatened accused No.1 and consequently engineered the said act of committing suicide.

Without going into the defence of the accused, as seen from the complaint and the Remand Report, these petitioners, who are in-laws of victim, except stating that they have abetted accused No.1, there are no specific allegations against these petitioners. 6.

For the said reason, the petitioners/accused Nos.2 to 5 can be considered to be released on bail.

Accordingly, the Criminal Petition is allowed and the petitioners/accused Nos.2 to 5 are granted bail subject to the following conditions:

i) The petitioners/accused Nos.2 to 5 are directed to be released on bail on their executing personal bond for a sum of

Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each, to the satisfaction of Principal Judicial Magistrate of First Class, Warangal.

ii) After release on bail, the petitioner Nos.1 and 3/accused Nos.2 and 4 shall appear before the Station House Officer, Geesuguda Police Station, Warangal District, on every Monday for a period of eight weeks, thereafter as and when required. iii) The petitioner Nos.2 and 4/accused Nos.3 and 5 shall appear before the Station House Officer, Geesugonda Police Station, Warangal District, as and when required. iv) The petitioners/accused Nos.2 to 5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
