THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14481 of 2015 ORDER:

The relief sought for in this writ petition is to declare the action of the 2nd respondent in not registering the F.I.R. against respondents 3 to 6 in pursuance of the complaint dated 01.05.2015 lodged by the petitioner as illegal and arbitrary.

Heard both sides.

In case the 2nd respondent is not registering F.I.R. in pursuance of the complaint lodged by the petitioner or if the complaint allegations do not disclose commission of any cognizable offence, then the remedy available to the petitioner is to file a complaint before the higher officials in terms of Section 154 of Cr.P.C. or before the concerned Magistrate.

Therefore, the writ petition is disposed of, giving liberty to the petitioner to file a complaint either before the higher officials or before the concerned Magistrate, in accordance with law.
