HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 48 OF 2009 JUDGMENT: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This appeal is directed against the order dated 06-11-2008 whereby the appellant's writ petition came to be dismissed on merits. In the writ petition, the appellant challenged the order terminating his licence which was subsisting till 20-07-2011. On 0402-2009, while admitting the appeal, the following order was passed:

"It is stated by Smt. WVS Rajeswari, learned counsel for the respondent No.1, that the appellant is already evicted on 11.1.2009 and possession is with the A.P.S.R.T.C. The above statement is disputed by Sri P.V. Vidya Sagar, counsel for the appellant stating that the appellant is still in possession of schedule telephone booth.

Recording the same, we direct that the status quo obtaining as on today shall be maintained.

We make it clear that this order does not preclude the appellant from making an application for the grant of telephone booth independently to the T.T.D."

Keeping the order dated 04-02-2009 in view and considering that the licence was subsisting till 20-07-2011, nothing further survives in the writ appeal.

Hence, the appeal is disposed of as rendered infructuous. Miscellaneous petitions, if any, also stand disposed of. No order as to costs.
