HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.222 of 2015 ORDER :

This Transfer Criminal Petition is filed by the Petitioner under Section 407 Cr.P.C seeking to TRANSFER m.c. No.4 of 2015 from the file of Additional Judicial Magistrate of the First Class, Ramachandrapuram to the Court of Munsif Magistrate, Ranga Reddy District or to the Family Court at Ranga Reddy District for being tried along with C.C. No.334 of 2013 on the file of XIV Metropolitan Magistrate, Ranga Reddy District.

2) Heard the learned counsel for the petitioner and the 1st respondent-State represented by the Public Prosecutor before admission, before ordering notice to the 2nd respondent and perused the material on record.

3) On hearing and perusal of the material on record, there are no grounds to transfer the maintenance case, as remedy is available under Section 126(2) Cr.P.C to proceed with the matter in the absence of a party when representing through Advocate to dispense with personal appearance to invoke by filing an application to that effect before the learned Magistrate, for the learned Magistrate to hear and consider by virtue of this order.

4) With the above observations, this transfer criminal petition is disposed of. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
