HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Civil Revision Petition No. 3552 of 2015 Order:

The defendant-tenant in OS No.78 of 2015 on the file of I Additional Junior Civil Judge, Visakhapatnam, is the petitioner herein. The said suit was filed by the respondent-landlord seeking eviction of the petitioner-tenant from the suit schedule property. In the said suit, the respondent-landlord filed IA No.409 of 2015, under Order XV-A of CPC and when the said application was disposed of along with the suit, the present Civil Revision Petition is filed.

2. Now, it is submitted by both the counsel that OS No.78 of 2015 itself is disposed of and the petitioner-tenant filed an appeal before the VII Additional District Judge, Visakhapatnam, and the same is pending. Learned counsel for the petitioner submits that the petitioner paid the arrears of rent as on date and nothing is due.

3. In view of the same, recording the statement of the learned counsel for the petitioner-tenant, which is not disputed by the learned counsel for the respondent-landlord, this Civil Revision Petition is closed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in the Civil Revision Petition shall stand closed. ________________________ A.
