THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41817 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in not providing police aid for further construction of temple i.e., Sri Cholabamba temple in survey No.671-2A at Amarapura Village and Mandal, Ananthapur District, as illegal and arbitrary, and consequently, to direct the fourth respondent not to issue any possession certificate to the fifth respondent.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner Trust is in possession of the above mentioned land and is taking up further construction activity in the temple land. However, the fifth respondent and his henchmen are trespassing into the lands of the petitioner Trust and are starting to make structures and are threatening the villagers and members of the Trust with deadly weapons. The fifth respondent is also trying to get possession certificate with the political support . Hence, the learned counsel for the petitioner seeks a direction to the third respondent to provide police protection for further constructions and also to direct the third respondent not to give possession certificate to the fifth respondent.

Considering the facts and circumstances of the case, the petitioner Trust is directed to give representation to the third respondent seeking police aid to the petitioner Trust for taking up further construction activities and on such representation being filed, the third respondent is directed to consider the representation and provide police protection to the properties of the petitioner Trust if there is any necessity to provide police protection. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.12.2016 pln
