.....RESPONDENTS Petition Under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the in action of the 3rd respondent in not taking action against sth respondent as per rules amounts to disregard to the statutory provisions of the Act, as the 5th respondent is continuing illegally in 4th respondent society violating the statutory provisions laid down under the provisions of A.P.C.S. Act, 1964 and consequently direct the 3rd respondent to
take immediate action against the 5th respondent u/s 21-A (1-A) of the APCS Act, 7 ot 1964.

In this writ petition, the petitioner seeking declaration that the action of respondent No.3 in not taking action against respondent No'5 as per rules, amounts to disregard of the statutory provisions of the Act and as the respondent No.5 is continuing illegally in respondent No'4 society violating the statutory provisions laid down under the provisions of A.P.C.S Act, 1964 it is illegal, arbitrary and to consequently direct respondent No.3 to take immediate action against respondent No'5 under Section 21-A (1-A) of the APCS Act,7 of 1964 and to pass such other orders.

Learned Government Pleader for the Industries and Commerce filed a copy of the instructions vide Rc'No'7BB/2016-B' dated 14.1O.2O24, according to which, the permission of respondent No'5 as person in-charge of the society was only till 09'02'2018' Thereafter' the official person in-charge has been appolnted and the official person in-charge is now continuing to look-after the affairs of the society' Therefore, the cause in this writ petition does not survives' 3.
Inspite of Printing the name of the counsel in the cause list, there is no appearance on behalf of the petitioner'

In view of the instructions submitted by learned Government Pleader for Industries and Commerce, the writ petition ls closed as infructuous.
Miscellaneous applications, if any, pending in this Writ Petition, shall stand closed. No order as to costs.
