THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18498 OF 2016 ORDER:

This writ petition came to be filed seeking the following relief : "To issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the action of the 2nd respondent in not passing any orders upon the representation made by the petitioner on 17.03.2016 for shifting of A-4 shop from Ward No.6, Jodugullapalem to D.No.25-12-39, Godavariveedhi, Ward No.25, Visakhapatnam, as illegal, arbitrary and violative of principle of natural justice and contrary to the Article 14 of Constitution of India and consequently direct the respondents not to invoke bank guarantee furnished by the petitioner for running the A-4 shop business situated at Ward No.6, Jodugullapalem, Visakhapatnam." Heard learned counsel for the petitioner and learned Government Pleader for Prohibition & Excise.

Though various grounds are raised in the affidavit filed in support of the writ petition, learned counsel for the petitioner submits that the petitioner submitted a representation on 17.03.2016 to the Commissioner of Prohibition and Excise, Andhra Pradesh, Hyderabad (2nd respondent) for shifting of A-4 shop from Ward No.6, Jodugullapalem to D.No.25-12-39, Godavariveedhi, Ward No.25, Visakhapatnam, but till date no orders are passed on his representation.

Having regard to the facts and circumstances of the case, and the submissions of learned counsel for the petitioner, without expressing any opinion on merits, the writ petition is disposed of, directing the 2nd respondent to pass appropriate orders on the representation submitted by the petitioner on 17.03.2016 as expeditiously as possible, preferably within a period of four

(4) weeks from the date of receipt of copy of this order. It is made clear that the petitioner shall also be given an opportunity of hearing before passing the orders. There shall be no order as to costs.

Miscellaneous petitions, pending, if any, in the writ petition, shall stand closed.
