HONOURABLE SRI JUSTICE N. BALAYOGI CRIMINAL PETITION No. 7681 OF 2011 ORDER:

As seen from the proceedings sheet, it is found that the matter was admitted on 27.08.2011 and interim stay was granted on the same day in Crl.M.P.No.8097 of 2011. Thereafter the matter underwent adjournments from time to time and on 23.1.2018 the matter was directed to be listed to 30.01.2018 finally at the request of the petitioners while making an observation that on the next date of hearing no adjournment would be granted under any circumstances. When the matter was listed to 30.01.2018, however, learned Counsel for the petitioners sought time to this date. To day also, though the matter is posted finally, learned Counsel for the petitioners is seeking time. It emerges that petitioners are not interested to argue the matter for final disposal. In the circumstances, this Court has no option except to dismiss the petition for non prosecution. Accordingly the Criminal Petition is dismissed for non prosecution. The interim stay granted on 27.8.2011 in Crl.M.P.No. 8097 of 2011 shall stand vacated.

Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. ------------------------------- JUSTICE N. BALAYOGI DATED 6TH FEBRUARY, 2018.
