HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27639 OF 2018 O R D E R :

This writ petition is filed challenging the action of 3rd respondent in harassing the petitioners by falsely implicating the petitioners in FIR No.97/2018 on the file of Draksharama P.S at the instance of 4th respondent, though an order was passed by this Court in Crl.Petition No.6435/2018 filed by the petitioners, directing the respondent police to follow the guidelines issued by the Apex Court in Rajesh Sharma and others v. State of U.P. and another (2017 (7) SCJ 94).

Learned counsel for the petitioners submits that though this Court directed the respondent police to follow the guidelines in Rajesh Sharma's case in the Criminal Petition No.6435 of 2018 filed by the petitioners to quash the proceedings in Cr.No.97/2018, the 3rd respondent issued notice dated: nil, directing the petitioners to appear before the family counselling centre under the supervision of Additional JFCM Court, Ramachandrapuram, on 01.08.2018.

Learned Assistant Government Pleader for Home produced written instructions stating that during the course of investigation the 3rd respondent has issued notice to the petitioners to appear for the family counselling centre on 01.08.2018, but the petitioners did not attend for counselling.

In this case it is to be seen that notice dated:nil, was issued to the petitioners to attend the family counselling on 01.08.2018, as per the orders of this Court in Crl.P.No.6435/2018. It is not the case of the petitioner that family counselling is not constituted as per the guidelines in Rajesh Sharma's case. Already there is direction by this Court in Crl.P.No.6435/2018 to follow the guidelines of Apex Court in Rajesh Sharma's case. In view of the same, the writ petition is disposed of directing the petitioners to appear before the family counselling centre which was under the supervision of Additional Judicial First Class Magistrate Court, Ramachandrapuram. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
