THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19604 OF 2016 ORDER:

The case of the petitioners is that they are the owners of lands to an extent of Ac.2.15 guntas each in Sy.No.481/AA1 of Eeratwanipally, Penemilla Village of Uppununthala Mandal, Mahabubnagar District, and the same are ancestral properties and they are raising crops therein. The petitioners were also issued Pattedar Pass Books and title deeds and their names were also entered in the revenue records. The petitioners' lands are adjacent to the Nanapuram cheruvu which was small tank consisting of Ac.15.37 guntas. The grievance of the petitioners is that the respondent authorities without issuing any notice to the petitioners are trying to strengthen the tank by digging mud from the adjacent lands, as a result, petitioners' lands will be submerged. Hence, they filed the present writ petition.

Heard learned counsel for the petitioners.

Learned Government Pleader for Irrigation states that the respondents are only strengthening the bund and there is no question of increasing the bund and they are only de-silting the sand from the existing land.

Recording the aforesaid submission of the learned Government Pleader, this writ petition is disposed of directing respondents not to interfere with possession of the petitioners' over the subject lands to an extent of Ac.2.15 guntas each in

Sy.No.481/AA1 of Eeratwanipally, Penemilla Village of Uppununthala Mandal, Mahabubnagar District. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
