HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 9665 of 2006 ORDER:

This Writ Petition is filed against the order passed by the respondents in demanding the interest vide letter no. A/58184/05 dated 29.9.2005 in regard to the payment of renewal of annual licence fee of the petitioner. It is stated in the affidavit that the petitioner has already paid the annual licence fee and there is surplus annual licence fee collected and the same has to be refunded.

Sri R. Shyam, learned Assistant Government Pleader submits that the subject matter is squarely covered by the judgment of the Hon'ble Supreme Court in Civil Appeal No. 6317 of 1997 dated 28.9.2000 wherein the Hon'ble Supreme Court has held that the licence fee paid shall be appropriate and any excess amount collected, according to the petitioner, shall not be refunded with prospective effect.

In the light of the above, the Writ Petition is dismissed. There shall be no order as to costs.

As a sequel there to, miscellaneous applications, pending if any, shall stand closed.
