THE HONOURABLE DR.JUSTICE G.RADHA RANI CRIMINAL PETITION No.13034 OF 2024 O R D E R:

This Criminal Petition is filed by the petitioner - Accused No.6 under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhitha (for short "BNSS") seeking regular bail in Crime No.804 of 2024 on the file of Raidurgam Police Station, Cyberabad District registered for the offences punishable under Sections 8(c) read with 22(c), 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The case of the prosecution in brief was that the petitioner - A6 along with accused Nos.4 and 5 were found in possession of commercial quantity of Heroin of 620 grams while proceeding in a Mahindra XUV 500 car. The police of Raidurgam arrested the petitioner on 15.08.2024 along with accused Nos.4 and 5 and seized the contraband, car and their mobiles and registered the above case.

Heard the learned counsel for the petitioner-Accused No.6 and the learned Additional Public Prosecutor for the respondentState.

Learned counsel for the petitioner-Accused No.6 submitted that the entire investigation was completed. The material objects were seized including the Narcotic Drugs. Except filing the charge sheet nothing was left to be completed. The petitioner earlier moved two regular bail applications, which were dismissed by the XII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar. The accused No.4 was granted bail by this court on 30.10.2024 and accused No.5 was also enlarged on bail on 01.10.2024. The petitioner - A6 also stands on the same footing as that of the other accused persons and prayed to enlarge the petitionerAccused No.6 on bail. 5.

Learned Additional Public Prosecutor opposed grant of bail to the petitioner but however, reported that no criminal antecedents were reported against him.

Perused the record. Considering that the petitioner was a student, aged about 19 years and there are no criminal antecedents reported against him and the other two accused persons who were also along with him in the car at the time of seizure of the contraband were enlarged on bail by this court, it is considered fit to enlarge the

petitioner-Accused No.6 on bail.

In the result, the Criminal Petition is allowed directing the petitioner-Accused No.6 to be released on regular bail subject to the following conditions:

i).

The petitioner - Accused No.6 shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of the I Additional District and Sessions, Judge, at Ranga Reddy District at L.B.Nagar.

ii). The petitioner - Accused No.6 shall abide by the other conditions stipulated in Section 480 (3) of Bharatiya Nagarik Suraksha Sanhitha, 2023.
