THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38559 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in not completing the investigation in Crime No.200 of 2016, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that the petitioner lodged the present complaint against respondents 3 to 7 alleging that respondents 4 to 7 conspired with 3rd respondent and forged documents related to the land of the petitioner in the Sub-Registrar records as document No.2471 of 2006 in RS.No.202/3 by mentioning an extent of land as Ac. 0.05 cents to get wrongful gain with a common intention. The main grievance of the petitioner is that though the complaint is lodged by the petitioner is registered by the 2nd respondent as Crime No.

200 of 2016, but the 2nd respondent is not completing the investigation. Learned Assistant Government Pleader for Home filed counter affidavit on behalf of the 2nd respondent, wherein it is stated as follows: "It is submitted that, based on the above complaint, a case in Crime No.200/2016 u/s 465, 467 IPC was registered on 5.10.2016 and took up for investigation. During the course of investigation, the complainant and L.Ws. 2 to 5 were examined and recorded their detailed statements. Later collected the documents relating to the subject property from the petitioner herein. On 12.10.2016, L.Ws. 6 and 7 were examined and recorded their detailed statements.

During the course of investigation, the Sub-Registrar, Jangareddygudem was requested to furnish the certified copies of the transactions of the land in question for proceeding with further investigation and the same are awaited. In this case some more witnesses have to be examined and the case is under investigation. It is submitted that, after completion of investigation, appropriate report will be filed before the concerned jurisdiction court."

In view of the said stand taken by the 2nd respondent, the 2nd respondent is directed to complete the investigation in Crime No.200 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law. The petitioner is directed to produce all the relevant documents, which are necessary for the completion of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 7th December, 2016 KL
