HON'BLE SRI JUSTICE P. KESHAVA RAO I.A.No.1 of 2018 AND CRIMINAL REVISION CASE No.1232 of 2010 COMMON ORDER:

Heard the learned counsel for the petitioner and the de facto complainant.

The present revision case is filed questioning the judgment passed in Crl.A.No.265 of 2010 dated 02.07.2010 on the file of the IV Additional District and Sessions Judge, Guntur, confirming the order of conviction passed in C.C.No.189 of 2008 dated 19.05.2010 on the file of the Special Judicial Magistrate of First Class for Prohibition and Excise, Guntur.

The facts in brief are that the petitioner herein has been convicted for the offence under Section 498-A IPC. During the pendency of the revision case, the parties have settled the matter outside the Court and to have peace and tranquility, the de facto complainant wants to withdraw the case and to that effect she filed I.A.No.1 of 2018 to record the compromise and allow the criminal revision case by setting aside the judgment, conviction and sentence imposed against the revision petitioner in C.C.No.189 of 2008 dated 19.05.2010 on the file of the Special Judicial Magistrate of First Class for Prohibition and Excise, Guntur, as confirmed in Crl.A.No.265 of 2010 dated 02.07.2010 on the file of the IV Additional District and Sessions Judge, Guntur.

Both the parties present and are identified by their respective counsel. They produced the Xerox copies of the Aadhaar cards and the same are made as part of the record. Having regard to the facts and circumstances of the case and in view of the affidavit filed by the de facto complainant and the joint memo of compromise filed by both the parties, I.A.No.1 of 2018 is allowed.

Consequently, the criminal revision case is allowed. The conviction and sentence recorded against the accused by the Special Judicial Magistrate of First Class for Prohibition and Excise, Guntur, in C.C.No.189 of 2008 dated 19.05.2010, as confirmed by the IV Additional District and Sessions Judge, Guntur, in Crl.A.No.265 of 2010 dated 02.07.2010 are set aside and the accused is acquitted of the offence punishable under Section 498-A IPC.
