HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.18912 of 2017 ORDER:
This Writ Petition is filed with the prayer which reads as follows:- "to issue a Writ, order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not conducting any enquiry of the petitioners' repeated representation in latest one dated 08.05.2017 for granting of compensation in favour of them for an extent of Ac.11-27 guntas in S.Nos.49, 49-A, 49E, 50 & 51 of Pocharam Revenue Village, Kukkunuru Mandal, West Godavari District, as illegal, irregular, arbitrary & violative of provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules framed there under and violative of Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents to give opportunity to the petitioners to participate in the award enquiry and objection if any would be considered and pay the compensation to the petitioners in accordance with said Act and to pass such other order or orders."
Heard learned counsel for the petitioners and the learned Govt. Pleader for Land Acquisition representing respondents 1 to 3 and also perused the written instructions dt.13.06.2017 received by the learned Government Pleader from the Sub Collector & Land Acquisition Officer, Kukunoor, which shows that there are two daily newspaper publications, Gazette and in the locality regarding calling for objections with respect to the notification to participate in the enquiry to be conducted after 60 days from the date of respective publication and gazettes and
Dr. SSRB,J the time is still prevailing to comply with the objections for enquiry being held on 16.06.2017.
Having regard to the above, the writ petitioners can put forth their grievance with supporting material within three days from the date of receipt of this order by filing objections in the enquiry as to who are entitled to compensation to be determined to pay.
Accordingly, this writ petition is disposed of. Any further grievance of the petitioners is left open.
Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
