THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24841 of 2009 ORDER:
Heard Mr.A.Prabhakar Rao, learned counsel for petitioner and Assistant Government Pleader for respondents. The petitioner challenges proceedings in Order No.A2/6650/SocialAudit/2009, dated 09-11-2009, as illegal and unconstitutional.
At the time of hearing, having regard to the objection raised by respondents that against the order impugned in the writ petition, appeal is maintainable before the District Collector, the counsel for petitioner requests that the petitioner may be given liberty to avail the remedy of appeal, for the appellate authority can examine both factual and legal submissions.
The Assistant Government Pleader reports no objection to the submission of petitioner.
The writ petition is disposed of by this order. The petitioner is given liberty to file appeal within four weeks from the date of receipt of a copy of this order and if the appeal is presented, as permitted by this order, the appellate authority is directed to take the appeal on file without reference to limitation, and number the appeal and further directed to dispose of the appeal within a further period of three months. The parties are directed to maintain status-quo as on today for a period of four months from today. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
