HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1744 OF 2017 ORDER:
The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') requesting to quash the proceedings in D.V.C.No.5 of 2015 on the file of the Judicial First Class Magistrate, Husnabad.

Sri Ravi Kumar Vadlakonda, learned counsel for the petitioners, having elaborately argued the matter, drawn the attention to the order passed by the learned Additional Judicial First Class Magistrate, Husnabad, dated 04.08.2015 in Crl.M.P.No.936 of 2015 in D.V.C.No.5 of 2015, which is filed under Section 23 of the Protection of Women from Domestic Violence Act, 2005, whereby and whereunder, the learned Magistrate granted maintenance of Rs.6,000/- to the petitioner, who is the 2nd respondent herein. In spite of challenging the said order, the petitioners have come up with the present petition, but, however, would request to dispose of the present petition confining the argument only to the extent of dispensing with the presence of the petitioner Nos.2 to 8 in the aforesaid D.V.C. case. The request appears to be reasonable.

Therefore, the criminal petition is disposed of dispensing with the presence of the petitioner Nos.2 to 8 and petitioner No.1 would represent petitioner Nos.2 to 8 before the Court below. It is also made clear that petitioner Nos.2 to 8 shall appear as and when directed by the learned Magistrate whenever their presence is necessary.

With the above direction, the criminal petition is disposed of at the admission stage itself.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
