HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.10279 of 2021 O R D E R:

This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.1 in connection with Crime No.764 of 2021 of Raidurgam Police Station, registered for the offences punishable under Sections 364-A, 342 and 506 of IPC, seeking bail. 2.

A report was lodged by the de facto complainant stating that on 06.12.2021 at 1530 hours when he along with his friends went to Good Vibes Cafe at Khajaguda and thereafter when he was proceeding to his case, some unknown persons came to him stating that they are task force police and forcibly took him in their Car bearing No.TS08 GZ 7745. They took him to seed company at Dundigal through outer ring road, beat him with iron rods, demanded Rs.5 lakhs to leave him and threatened to call his wife. They also provided account No.30341010007468, IFSC No.CNRB0013034 belongs to Siri More Feeds Pvt. Ltd., for transferring the amount. Later, the complainant called his wife and asked her to transfer the amount. On 07.12.2021 when the accused persons were talking, he escaped from them. Basing on the said report, the present crime was registered.

Heard Sri Sunkari Janardhan Goud, learned counsel for petitioner and learned Assistant Public Prosecutor appearing on behalf of respondent-State.

Learned counsel for petitioner submits that petitioner is alleged to have committed the offences punishable under Sections 364-A, 342 and 506 of IPC. He submits that as per the remand report, petitioner has transferred Rs.5 lakhs to the account belongs to

Vidyasagar, who is friend of de facto complainant, as he assured to secured loan for him and later, when the petitioner demanded the complainant to pay back the amount, the present case was foisted against him. He submits that petitioner is unconnected with the alleged crime and he has no criminal antecedents. He submits that petitioner was arrested on 08.12.2021 and since then he is languishing in jail, as such his case may be considered for grant of bail.

Per contra, learned Assistant Public Prosecutor submits that as per the investigation, petitioner has transferred Rs.10 lakhs to the account of friend of de facto complainant, however when he failed to repay the amount, he was forcibly abducted and assaulted. He submits that investigation is pending and so far five witnesses were examined and at this stage, petitioner is not entitled for bail. 6.

Taking into consideration the fact that petitioner was arrested on 08.12.2021 and also disputes are prevailing between the parties, this Court deems it appropriate to enlarge the petitioner on bail. 7.

In the result, criminal petition is allowed and the petitioner / Accused No.1 shall be enlarged on bail in connection with Crime No.764 of 2021 of Raidurgam Police Station, on his executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for a like sum to the satisfaction of IV Additional Metropolitan Sessions Judge, Ranga Reddy District. ___________________________ LALITHA KANNEGANTI, J 7th January, 2022 PVD
