WRIT PETITION NO. 30769 OF 2016 O R D E R :
Vide the present writ petition, the petitioners seek direction thereby directing the respondents 1 to 3 to take steps to see that pending enquiry in connection with the functioning of the sixth respondent Association are strictly conducted by law, spirit, rules and the guidelines of the first respondent-Railway Board at all times if necessary by giving fresh schedule for elections.
2. Learned counsel appearing on behalf of the petitioners submits that for the aforesaid purpose the petitioners have been making representations dated 05/9/2014, 03/01/2015, 06/06/2016 and 18/7/2016, however, till date there is no response from the respondents.
3. Learned standing counsel appearing on behalf of Railways on advance notice has raised objection that the present writ petition is not maintainable for the reason that elections of the society, which is registered under the Societies Registration Act, is to be held in September/October 2016.
4. Be that as it may, since the petitioners have made representations to respondents 1 and 2, it is the duty of the respondents 1 and 2 atleast to inform the petitioners about the action taken.
5. In view of the above, I hereby direct the respondents 1 and 2 that before taking any steps, the representations noted above made by the petitioners shall be taken into consideration and if the respondents 1 and 2 found that the representations are not maintainable, the decision shall be conveyed to the petitioners in writing.
6. In view of the above direction, the writ petition is disposed of at the stage of admission. No costs.
7. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
